Terms of Service

1. Acceptance of Terms

By accessing or using ExamLytix, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to any part of these Terms, please do not use our application.

These Terms constitute the entire and exclusive agreement between you and ExamLytix with respect to your use of the app, and supersede any prior agreements, understandings, or representations.

2. Use of the App

Eligibility. ExamLytix is intended for users who are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent. By using ExamLytix, you warrant that you meet these eligibility requirements.

Acceptable Use. You agree to use ExamLytix only for lawful purposes. You must not:

• Use the app in any way that violates applicable local, national, or international laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble any part of the application or its underlying algorithms (including the SM-2 spaced repetition system).
• Use automated bots, scrapers, or similar tools to access or interact with the app.
• Attempt to gain unauthorized access to our servers, databases, or other systems connected to ExamLytix.
• Transmit any unsolicited or unauthorized advertising, spam, or promotional materials.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the app to harass, harm, or intimidate other users.

We reserve the right to restrict or terminate access for any user who violates these usage policies.

3. User Accounts

To access the full features of ExamLytix, you must create an account. You may register using:

• Email & Password — via Firebase Authentication.
• Google Sign-In — using your Google account via OAuth 2.0.
• Apple Sign-In — using your Apple ID via Sign in with Apple.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, complete, and up-to-date registration information.
• Notify us immediately at support@examlytix.com of any unauthorized use of your account.
• Not share your account credentials with any third party.
• Not create multiple accounts to abuse free-tier features or promotions.

All user study data — including exam configurations, topic progress, session logs, and SM-2 interval data — is stored securely on Google Firebase (Firestore).

4. Intellectual Property

All content, features, and functionality of ExamLytix — including but not limited to the application's source code, design, graphics, logos, algorithms, UI/UX, and written content — are the exclusive property of ExamLytix and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the app strictly for your personal, non-commercial study purposes.

You may not:

• Copy, reproduce, modify, or distribute any part of the app without our prior written consent.
• Use ExamLytix's name, logo, or branding in any manner that implies endorsement without authorization.
• Create derivative works based on any content or functionality of ExamLytix.

Any user-generated content you input into the app remains your intellectual property. You grant ExamLytix a non-exclusive licence to process and store this content solely to deliver the service to you.

5. Subscriptions & Payments

ExamLytix may offer free and paid subscription tiers. If you purchase a paid subscription, the following terms apply:

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. All billing is handled by the respective platform.
• Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: All purchases are subject to the refund policy of the respective platform. ExamLytix does not independently process refunds.
• Price Changes: We reserve the right to change subscription pricing with advance notice. Continued use after the change constitutes acceptance of new pricing.
• Free Trial: Where offered, free trials convert to a paid subscription at the end of the trial period unless cancelled beforehand.

6. Disclaimers & Limitation of Liability

As-Is Service. ExamLytix is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• The app will be uninterrupted, error-free, or completely secure at all times.
• Any study plans, analytics, or spaced repetition schedules generated by the app will result in specific academic outcomes or exam results.
• Push notifications will be delivered on time or at all, as delivery depends on device settings and third-party services.

Limitation of Liability. To the maximum extent permitted by applicable law, ExamLytix and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app.

Our total liability to you for any claim shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) USD $10.

7. Termination

We reserve the right to suspend or terminate your account and access to ExamLytix at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users, third parties, or ExamLytix.

You may delete your account and all associated data at any time by visiting our Account Deletion page or by contacting us at support@examlytix.com.

Upon termination:

• Your right to access and use the app ceases immediately.
• All study data associated with your account will be permanently deleted within 30 days.
• Any active paid subscription will not be automatically refunded; you retain access until the end of the current billing period.

Sections 4 (Intellectual Property), 6 (Disclaimers & Limitation of Liability), and any other provisions that by their nature should survive, will survive termination.

8. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices, app features, or legal requirements. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via an in-app notification or push notification (where enabled).
• In cases of significant changes, request your re-acknowledgement before continued use.

Your continued use of ExamLytix after any changes become effective constitutes your acceptance of the revised Terms. The most current version will always be available at examlytix.com/terms.
